By downloading, installing, or using Fovabera ("the App," "we," "our," or "us"), you ("you," "your," or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Fovabera.
2. Description of Service
Fovabera is a personal habit-tracking and motivation application. It is not a medical device and does not provide medical or health services. The App provides:
Personal tracking of your progress and milestones
Statistics such as days tracked, milestones reached, and money saved
Motivational notifications
Goal-setting and reward features
Community statistics (anonymous)
3. Eligibility
You must be at least 18 years old to use Fovabera. By using the App, you represent and warrant that:
You are at least 18 years of age
You have the legal capacity to enter into a binding agreement
You will use the App in compliance with these Terms and applicable laws
4. Not a Medical Device
⚠️ IMPORTANT: Fovabera is a personal habit-tracking and motivation tool. It is not a medical device and does not diagnose, treat, cure, or prevent any disease or health condition, nor does it provide medical, clinical, or health advice or services.
Fovabera is a motivational and tracking tool only.
The App is not a substitute for professional advice of any kind.
The App does not measure or process any biometric or medical health data.
The general information and statistics shown in the App (such as counters, milestones, and savings estimates) are for motivational purposes only and may not apply to your individual circumstances.
For any medical concern, please consult a qualified professional.
5. Account Registration
To use Fovabera, you must create an account. You agree to:
Provide accurate, current, and complete information during registration
Maintain the security of your password and account
Notify us immediately of any unauthorized access to your account
Be responsible for all activities under your account
Not create accounts on behalf of others or share your account credentials
6. Premium Features and Payments
6.1 Free Use and Premium Features
Fovabera is free to use. For the first 7 days, all features are available to everyone. After this 7-day period, the following features require a one-time premium purchase:
Reward cards (setting and claiming personal rewards with the money you save)
All other features of the App remain free.
6.2 One-Time Purchase
The premium purchase is a one-time payment that grants permanent, unlimited access to the premium features. There are no recurring subscriptions and no automatic renewals — you are not charged again.
6.3 Payment Processing
All payments are processed by Apple App Store (iOS) or Google Play Store (Android)
We do not store or process your payment information
Prices are shown in the App at the time of purchase and vary by country and region
6.4 Refunds
Refund policies are governed by the platform you used to purchase (Apple App Store or Google Play Store). We do not directly process refunds. Premium is non-refundable after purchase except where required by law.
7. User Conduct
When using Fovabera, you agree NOT to:

❌ Attempt to gain unauthorized access to other users' accounts or our systems
❌ Reverse engineer, decompile, or disassemble the App
❌ Use automated systems (bots, scrapers) to access the App
❌ Interfere with the proper functioning of the App
❌ Upload or transmit harmful code, viruses, or malware
❌ Impersonate another person or entity
❌ Violate any applicable laws or regulations
❌ Use the App to harass, abuse, or harm others
8. Intellectual Property
8.1 Our Rights
Fovabera and all its content, features, design, code, logos, and trademarks are the exclusive property of Fovabera and are protected by international copyright, trademark, and other intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
8.3 Your Content
You retain ownership of any data you input into Fovabera (such as your start date, personal notes, and wishlist items). By using the App, you grant us a license to use, store, and process this data solely to provide the service to you.
9. Privacy

10. Notifications
By using Fovabera, you consent to receive local push notifications related to:
Daily motivational reminders
Milestone celebrations
General progress and milestone updates
Important service announcements
You can disable notifications at any time through your device settings.
11. Service Availability
We strive to maintain Fovabera's availability 24/7 but do not guarantee uninterrupted service
We may temporarily suspend service for maintenance, updates, or unforeseen issues
We are not liable for any inconvenience caused by service interruptions
12. Updates and Changes
We may update Fovabera to add features, fix bugs, or improve performance. By using the App, you agree to:
Receive automatic updates (when enabled on your device)
Acknowledge that some features may change or be removed
Continue using the App at your own discretion after updates
13. Termination
13.1 By You
You may stop using Fovabera at any time by deleting your account through the App or by contacting us at ataseversoftware@gmail.com.
13.2 By Us
We reserve the right to suspend or terminate your account if you:
Violate these Terms
Engage in fraudulent or harmful activity
Use the App in a way that risks harm to other users or our systems
14. Disclaimers
14.1 "As Is" Service
Fovabera is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability of information
14.2 No Outcome Warranty
We make no warranties regarding any particular result from using Fovabera. Your progress depends on many personal factors beyond the App's control.
15. Limitation of Liability
To the maximum extent permitted by law:
We are not liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability for any claim arising from these Terms or your use of Fovabera shall not exceed the amount you paid us (if any) in the 12 months preceding the claim
Some jurisdictions do not allow these limitations, so they may not apply to you
16. Indemnification
You agree to indemnify and hold harmless Fovabera, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
Your use of Fovabera
Your violation of these Terms
Your violation of any rights of another party
Your violation of any applicable law
17. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of Fovabera shall be resolved in the courts of Eskişehir, Türkiye, unless required otherwise by mandatory consumer protection laws of your country of residence.
18. International Use
Fovabera is accessible globally. By using the App from outside Türkiye:
You agree to comply with all applicable local laws
You acknowledge that data may be transferred to and stored in countries other than your own
You are responsible for ensuring your use complies with your local regulations
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Fovabera regarding the use of the App and supersede all prior agreements.
21. Changes to These Terms
We may update these Terms from time to time. When we do:

We will update the "Last Updated" date at the top
For significant changes, we will notify you via email or in-app notification
Continued use of Fovabera after changes means you accept the updated Terms
