By downloading, installing, or using Ashward ("the App," "we," "our," or "us"), you ("you," "your," or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Ashward.

2. Description of Service

Ashward is a mobile application designed to help users on their journey to quit smoking. The App provides:

• Personal tracking of quit-smoking progress
• Statistics on cigarettes avoided, money saved, and health benefits
• Motivational notifications
• Goal-setting and reward features
• Community statistics (anonymous)

3. Eligibility

You must be at least 18 years old to use Ashward. By using the App, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You will use the App in compliance with these Terms and applicable laws

4. Medical Disclaimer

⚠️ IMPORTANT: Ashward is not a medical device and does not provide medical advice, diagnosis, or treatment.

• Ashward is a motivational and tracking tool only
• The App is not a substitute for professional medical advice
• Always consult a qualified healthcare provider for medical advice related to smoking cessation
• If you experience severe withdrawal symptoms, depression, suicidal thoughts, or any medical emergency, seek immediate professional help

The information and statistics provided by Ashward (such as "life regained" or "health improvements") are based on general scientific research and may not apply to your individual circumstances.

5. Account Registration

To use Ashward, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities under your account
• Not create accounts on behalf of others or share your account credentials

6. Subscription and Payments

6.1 Free and Premium Features

Ashward offers both free and premium features. Premium features may require a paid subscription.

6.2 Payment Processing

• All payments are processed by the Apple App Store
• Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
• We do not store or process your payment information
• Subscription management (cancellation, refunds) is handled through your App Store account

6.3 Pricing Changes

We reserve the right to change subscription pricing. You will be notified of any price changes before they take effect. Continued use of the premium service after a price change constitutes acceptance of the new price.

6.4 Refunds

Refund policies are governed by the Apple App Store. We do not directly process refunds.

7. User Conduct

When using Ashward, you agree NOT to:

• ❌ Use the App for any illegal purpose
• ❌ Attempt to gain unauthorized access to other users' accounts or our systems
• ❌ Reverse engineer, decompile, or disassemble the App
• ❌ Use automated systems (bots, scrapers) to access the App
• ❌ Interfere with the proper functioning of the App
• ❌ Upload or transmit harmful code, viruses, or malware
• ❌ Impersonate another person or entity
• ❌ Violate any applicable laws or regulations
• ❌ Use the App to harass, abuse, or harm others

8. Intellectual Property

8.1 Our Rights

Ashward and all its content, features, design, code, logos, and trademarks are the exclusive property of Ashward and are protected by international copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

8.3 Your Content

You retain ownership of any data you input into Ashward (such as quit dates, slip-up notes, wishlist items). By using the App, you grant us a license to use, store, and process this data solely to provide the service to you.

9. Privacy

Your use of Ashward is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You can review the Privacy Policy at any time from within the app (Profile → Privacy Policy).

10. Notifications

By using Ashward, you consent to receive local push notifications related to:

• Daily motivational reminders
• Milestone celebrations
• Health benefit updates
• Important service announcements

You can disable notifications at any time through your device settings.

11. Service Availability

• We strive to maintain Ashward's availability 24/7 but do not guarantee uninterrupted service
• We may temporarily suspend service for maintenance, updates, or unforeseen issues
• We are not liable for any inconvenience caused by service interruptions

12. Updates and Changes

We may update Ashward to add features, fix bugs, or improve performance. By using the App, you agree to:

• Receive automatic updates (when enabled on your device)
• Acknowledge that some features may change or be removed
• Continue using the App at your own discretion after updates

13. Termination

13.1 By You

You may stop using Ashward at any time by deleting your account through the App or by contacting us at ataseversoftware@gmail.com.

13.2 By Us

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or harmful activity
• Use the App in a way that risks harm to other users or our systems

14. Disclaimers

14.1 "As Is" Service

Ashward is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of information

14.2 Health and Safety

We make no warranties that Ashward will help you successfully quit smoking. Quitting smoking is a personal journey that depends on many factors beyond the App's control.

15. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claim arising from these Terms or your use of Ashward shall not exceed the amount you paid us (if any) in the 12 months preceding the claim
• Some jurisdictions do not allow these limitations, so they may not apply to you

16. Indemnification

You agree to indemnify and hold harmless Ashward, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of Ashward
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable law

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of Ashward shall be resolved in the courts of Eskişehir, Türkiye, unless required otherwise by mandatory consumer protection laws of your country of residence.

18. International Use

Ashward is accessible globally. By using the App from outside Türkiye:

• You agree to comply with all applicable local laws
• You acknowledge that data may be transferred to and stored in countries other than your own
• You are responsible for ensuring your use complies with your local regulations

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Ashward regarding the use of the App and supersede all prior agreements.

21. Changes to These Terms

We may update these Terms from time to time. When we do:

• We will post the updated Terms in the app and on our website (studio-releaf.github.io/ashward-legal)
• We will update the "Last Updated" date at the top
• For significant changes, we will notify you via email or in-app notification
• Continued use of Ashward after changes means you accept the updated Terms
